Terms of Service

1. Acceptance of Terms

By accessing or using ArylLabs, a service provided by GOUTAM BORO (GTM TRADE) ("the Service"), accessible from aryllabs.com, aryl.app, and aryl.cloud, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms apply to all users, including those who deploy websites, share files, create flipbooks, galleries, or any other content through the Service.

2. Service Description

ArylLabs provides a platform for deploying static websites, sharing files, creating interactive flipbooks, and hosting photo galleries. Content may be hosted on Cloudflare's infrastructure (R2, Workers, KV) and/or Google Drive, depending on the plan and features used.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration. You must be at least 13 years of age (or 16 in the EU) to use the Service.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all content you deploy, upload, share, or distribute through the Service. ArylLabs acts as a neutral hosting provider and does not endorse, verify, or pre-screen user content.

You agree NOT to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon the intellectual property rights of any third party
  • Distribute malware, viruses, spyware, or any other malicious code
  • Conduct phishing attacks, scams, or fraudulent activities
  • Host or distribute child sexual abuse material (CSAM) — this will result in immediate termination and law enforcement referral
  • Engage in harassment, doxxing, stalking, or threats of violence
  • Distribute content that promotes terrorism or violent extremism
  • Impersonate another person, entity, or ArylLabs itself
  • Use the Service to send unsolicited mass communications (spam)
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service to mine cryptocurrency or run compute-intensive tasks
  • Resell or redistribute the Service without authorization

5. Prohibited Content

The following types of content are strictly prohibited and may be removed without notice:

  • Child Sexual Abuse Material (CSAM): Any content depicting the sexual exploitation of minors. Discovery of such content will result in immediate account termination, content removal, and referral to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement agencies.
  • Malware & Phishing: Sites or files designed to harm users, steal credentials, or distribute malicious software.
  • Terrorism & Violent Extremism: Content that promotes, incites, or glorifies acts of terrorism or mass violence.
  • Non-consensual Intimate Imagery: Intimate images shared without the consent of the depicted individual(s).
  • Illegal Goods & Services: Content promoting the sale of illegal drugs, weapons, counterfeit goods, or stolen data.
  • Hate Speech: Content that promotes violence or hatred against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.

ArylLabs reserves the right to determine, in its sole discretion, what constitutes prohibited content and to remove such content or terminate accounts at any time.

6. Content Moderation & Removal

ArylLabs does not actively monitor or pre-screen user content. However, we reserve the right to review, remove, or disable access to any content that we believe violates these Terms or poses a risk to users, the Service, or third parties.

We may take any of the following actions at our discretion:

  • Issue a warning to the account holder
  • Temporarily suspend the offending content or account
  • Permanently terminate the account and delete all associated content
  • Report illegal activity to law enforcement authorities
  • Cooperate with law enforcement investigations when legally required

Abuse Reporting: If you encounter content that violates these Terms, please report it to abuse@aryllabs.com. We aim to review all reports within 48 hours.

7. DMCA & Copyright Infringement

ArylLabs respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been copied and is accessible on the Service in a way that constitutes copyright infringement, please send a DMCA takedown notice to:

Your notice must include:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, including the URL
  • Your contact information (name, address, phone, email)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on behalf of the owner
  • Your physical or electronic signature

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing content and notify the user. Users may submit a counter-notification if they believe the removal was in error.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will cease immediately.

For paid plans, termination due to ToS violations will not result in any refund for the remaining subscription period.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARYLLABS AND GOUTAM BORO EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

ArylLabs makes no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results obtained from the use of the Service will be accurate or reliable, or (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations. Any material downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk.

10. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARYLLABS, GOUTAM BORO, AND ANY AFFILIATES SHALL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY (WHETHER CONTRACT, TORT INCLUDING NEGLIGENCE, OR OTHERWISE) FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

THIS LIMITATION OF LIABILITY APPLIES EVEN IF IT CAUSES THE SERVICE OR THIS AGREEMENT TO FAIL OF ITS ESSENTIAL PURPOSE AND EVEN IF ARYLLABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL LIABILITY OF ARYLLABS FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50 USD) OR THE AMOUNT YOU PAID ARYLLABS IN THE PAST TWELVE MONTHS.

11. Indemnification

You agree to strongly indemnify, defend, and hold harmless ArylLabs, Goutam Boro, and associated agents, employees, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) that such parties may incur as a result of or arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any content you post, upload, or share through the Service; or (d) your violation of any rights of any other person or entity, including intellectual property infringement or privacy violations.

12. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Binding Arbitration: You and ArylLabs agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Service, shall be resolved by binding arbitration, rather than in court.

Class Action Waiver: YOU AND ARYLLABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

13. Governing Law

These Terms, and any dispute arising out of or related to them, shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

14. Modifications to Terms

ArylLabs reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
